Terms of service

These Terms of Service (“Terms”) govern the reuse (secondhand) business (buying and selling used items) and e-commerce services (collectively, the “Service”) operated in Hong Kong by WORLD FASHION (HONG KONG) CO., LIMITED. (“we,” “us,” or the “Company”). By using our physical store or website, you (“User” or “Customer”) acknowledge that you agree to these Terms.

Chapter 1: General Provisions

Article 1 (Definitions)

1. “Company” refers to WORLD FASHION (HONG KONG) CO., LIMITED.

2. “Service” refers to the secondhand purchase and sale of used items, as well as any associated e-commerce offerings by the Company in Hong Kong.

3. “User” means an individual or entity who agrees to these Terms and utilizes the Service.

4. “Member” refers to a User who registers through procedures designated by the Company, agrees to these Terms, and is approved by the Company.

5. “Points” means the points program granted at the time of purchase or buyback of used items, under separate rules defined by the Company.

Article 2 (Revision of Terms)

1. We may revise or amend these Terms as necessary. If a significant change is made, we will notify the Users through our website or other appropriate methods.

2. If Users continue using the Service after notification of changes, such use is deemed acceptance of the revised Terms.

Article 3 (User Environment)

Users are responsible for preparing communication devices, software, and an internet connection contract necessary to use the Service, at their own cost. Any related connection fees are also borne by the User.

Article 4 (Notifications from the Company)

1. The Company will notify Users of important matters through announcements on our website, email, or other methods we deem appropriate.

2. If the Company sends notices via email to the address provided by the User, such notices are considered complete at the time of sending.

Article 5 (Changes in Registration Information)

1. Users must promptly update any changed information (address, email, etc.) through the procedures designated by the Company.

2. The Company is not liable for damages or failure of notices if the User fails to update such information.

3. If incorrect information is registered, the Company may correct it within the necessary scope without notice to the User.

Chapter 2: Membership

Article 6 (Membership Registration)

1. Those who wish to register as Members must agree to these Terms and provide the required information in a manner designated by the Company.

2. If the User is a minor (for instance, under 18 years old under Hong Kong law), parental or legal guardian consent may be required.

3. Users may not register multiple accounts in their own name or use third-party or false information for registration.

Article 7 (Changes to Registered Information)

1. Members must promptly update any registration changes through procedures designated by the Company.

2. If notices or deliveries fail due to a member not updating information, the Company is not liable.

3. If it is found that registered information is false or incorrect, the Company may correct such information within the necessary scope.

Article 8 (Management of Member ID and Password)

1. Members shall manage their assigned Member ID and password at their own risk and shall not transfer or lend them to third parties.

2. If login occurs using matching Member ID and password, the Company deems such usage to be by the Member.

3. The Company is not liable for damages resulting from unauthorized use, except in cases of willful misconduct or gross negligence by the Company.

Article 9 (Points)

1. The Company may grant points to Users upon purchasing or selling used items. The rate and usage rules are defined separately by the Company.

2. Points cannot be redeemed for cash, nor can they be transferred or shared with other Users.

3. Points may be canceled if they expire or if the User violates these Terms, according to the Company’s criteria.

Chapter 3: Purchase and Sale of Used Items

Article 10 (Buying Used Items)

1. The Company may conduct buyback services for used items within the categories the Company handles.

2. If the User is a minor, parental or guardian consent may be required under Hong Kong law, and the Company will perform identity verification as required by related laws.

3. A sales contract is concluded once the User agrees to the valuation offered by the Company, upon which ownership of the item transfers to the Company.

Article 11 (Selling Products)

1. The Company sells secondhand (reuse) items through physical stores and e-commerce channels.

2. Product prices and stock availability may change without notice. If a pricing error is found, the Company may cancel or correct the order.

Chapter 4: Personal Data Handling

Article 12 (Privacy Policy)

1. The Company handles personal data obtained from Users in accordance with Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) and relevant laws.

2. Details on personal data handling and use of cookies are governed by the Company’s separate Privacy Policy and Cookie Policy.

Chapter 5: Disclaimer and Service Suspension

Article 13 (Disclaimer)

1. The Company is not liable for damages caused by network or computer failures, third-party misconduct, or system interruptions/delays/stoppages unless due to the Company’s willful misconduct or gross negligence.

2. The used items sold by the Company may vary in condition; if there is a discrepancy between a user’s expectation and the actual product condition, the Company is not liable unless there is gross negligence or willful misconduct on the part of the Company.

Article 14 (Suspension or Modification of Service)

1. The Company may suspend or alter all or part of the Service without prior notice to Users due to system maintenance, legal reasons, or any other necessity.

2. The Company is not liable for damages arising from such suspension, unless caused by the Company’s willful misconduct or gross negligence.

Chapter 6: Governing Law and Jurisdiction

Article 15 (Governing Law)

These Terms shall be governed by and interpreted in accordance with the laws of Hong Kong.

Article 16 (Dispute Resolution)

Any disputes related to these Terms shall be subject to the exclusive jurisdiction of the Hong Kong courts in the first instance.

Chapter 7: Miscellaneous

Article 17 (Matters Not Stipulated)

If any matter is not provided for in these Terms or any ambiguity arises, the User and the Company shall resolve it through sincere consultation.
